No Generic Parking Aggregator Licence Assumed
A technology marketplace that only connects independent owners and drivers usually does not need a single national parking-aggregator licence. That changes if the company itself operates parking lots, manages municipal/government parking, employs on-site parking staff, or contracts to run public parking.
Business and Tax Setup
- Use a proper business entity before public launch. Private Limited or LLP is usually stronger than an informal setup for marketplace liability, contracts, payments, and hiring.
- Assess GST registration and e-commerce operator obligations with a CA, especially if the platform collects consideration for supplies made by owners.
- Keep invoices, refunds, TCS/GSTR-8 applicability, owner payouts, and payment gateway settlement flows aligned with the final operating model.
Data Protection
Because the platform collects phone numbers, vehicle details, location data, payment metadata, support messages, and owner listing data, it needs clear privacy notices, purpose limitation, user rights handling, deletion processes, and security controls.
Intermediary Posture
Publish and enforce rules, user agreement, privacy policy, prohibited-content rules, support/grievance routes, and moderation procedures. Keep the product copy clear that owners, not the platform, are responsible for legal authority over listed spaces unless ParkingNearby signs a separate operating contract.
Launch Checklist
- Entity incorporation, GST review, payment gateway onboarding, accounting setup, refund process, and customer support escalation.
- Owner agreement, owner KYC path, authority declaration, photo/GPS verification, and listing moderation.
- Terms, privacy policy, refund/cancellation policy, grievance/support contact, insurance/liability wording, and city-specific operating review.
